Rising Star Bookings FZCO, doing business as Brassbell (hereinafter "Brassbell", "Brassbell Homes", "We", "Us", or "Our") operates an online platform connecting guests to accommodations (as defined below) and other described services (collectively, the "Services"). Please review the subsequent terms and conditions ("Terms"). These Terms include essential details concerning your legal responsibilities and rights and incorporate various limitations and exclusions pertaining to Our liability. By utilizing the Site, you commit to complying with and being legally bound by these Terms (collectively with any integrated terms, conditions, and/or policies, the "Terms"), whether or not you avail the Services or make any Reservations (as defined below). These Terms govern your interaction with and use of the Site, its Content (as defined below), and establish a legally binding contract between you and Brassbell Homes.
**1. TRADEMARKS**
The terms "BRASSBELL" and "BRASSBELL HOMES" are protected trademarks and service marks of Rising Star Bookings FZCO. All rights reserved. These and any other graphics, logos, trademarks, and service marks of Brassbell Homes may not be utilized without prior written consent from Brassbell Homes. Other trademarks, service marks, product names, company names, and logos visible on the Site are the property of their respective owners.
**2. SCOPE OF SERVICES**
Brassbell Homes is a professional management company focused on enhancing the modern travel experience in the alternative lodging industry. We lease vacation rental properties and large multifamily properties, furnishing all units according to our luxurious brand standards, including design upgrades. When you make a reservation with us, whether through the Site or third-party providers (like Airbnb, HomeAway, VRBO, Booking.com, Expedia), you are booking accommodations operated by Brassbell Homes.
**3. ELIGIBILITY**
You must be 18 years or older and able to form legally binding agreements to access and use the Site and Services. The Site and Services are designed for individuals aged 18 and above. Use of the Site and Services by individuals under 18 is strictly prohibited. By accessing or using the Site and/or Services, you affirm that you are 18 or older and understand and agree to these Terms. If you accept these Terms on behalf of a company or legal entity, you affirm that you have the authority to bind that entity to these Terms.
**4. CONTENT**
You acknowledge that the Site contains protected materials (collectively, "Content") like information, data, software, photographs, videos, graphics, music, and more, covered by copyrights, trademarks, trade secrets, or other proprietary rights. All Content is copyrighted as a collective work, and Brassbell Homes owns a copyright in the arrangement, selection, and enhancement of such Content. You may not modify, remove, publish, reproduce, distribute, or exploit any of the Content, in whole or part, without prior written consent. If no specific restrictions are indicated, you may make copies of portions of the Content for personal use while preserving all notices of copyright, trademarks, or proprietary rights. You may not upload, post, or distribute Content protected by copyright or other proprietary rights without Our written permission.
**5. HOW THE SITE AND SERVICES OPERATE**
The following sections are specifically relevant to booking Accommodations through the Site. When booking through third-party service providers (e.g., Airbnb, HomeAway, VRBO, Booking.com, Expedia), you are subject to their terms of service and agreements.
**A. Booking Accommodations and Reservation Procedure**
As outlined in Section 2 above, Brassbell Homes leases vacation rentals and multifamily properties. To book an Accommodation via the Site, you must search for properties in a desired city, select stay dates, and proceed through the "Reservation Procedure."
Upon selecting a property and stay dates, you must provide Personal Information, such as name and contact details, and Payment Information (credit card details), collected and processed in compliance with Our Privacy Policy. We use this information to book the Accommodation for you.
Your Personal Information may also be used for identity confirmation, transparent and security purposes, and compliance with applicable laws. If you are representing a company, you confirm you have the authority to bind the company to these Terms.
After completing the Reservation Procedure, We will send you a confirmation email with Accommodation details. Once booked, you are granted a limited license to use the Accommodation, while Brassbell Homes retains the right to re-enter in line with these Terms.
You must vacate the Accommodation by the checkout date specified in your confirmation. Overstaying without consent results in the forfeiture of your license to stay, and Brassbell Homes may charge Overstay Fees.
**B. Additional Fees**
In addition to Accommodation fees, Additional Fees (cleaning, service charges, taxes) may apply. These will be listed during the Reservation Procedure and detailed in the invoice sent to your email.
**C. Accommodation Extensions**
You can extend your stay, subject to availability, by contacting us 24 hours before checkout. Extensions incur Additional Fees.
**D. Unavailability and Situations Affecting Stay**
If an Accommodation becomes unavailable before your reservation, you'll be notified and offered a refund or relocation to another available property.
**E. Accommodation Modifications, Cancellations, and Refunds**
Reservations made at least 3 days before check-in are fully refundable if canceled at least 3 days before check-in. Cancellations made within 14 days are non-refundable. Third-party sites might have different policies.
**6. DAMAGE TO ACCOMMODATIONS**
Guests are responsible for leaving Accommodations in the condition they found them. Any damage incurred may result in charges. Guests and their invitees are responsible for their actions.
**7. WARRANTY DISCLAIMERS**
Your use of the Site and Services is at your own risk. We disclaim all warranties, including merchantability, fitness for a purpose, and non-infringement. We don't guarantee uninterrupted, accurate, or error-free service or results from using the Site and Services.
**8. LIMITATIONS OF LIABILITY**
You assume the risk of using the Site, Services, and Accommodations. Neither Brassbell Homes nor its affiliates, officers, employees, or providers will be liable for direct, indirect, incidental, consequential, exemplary damages. We're not responsible for your reliance on Site content or errors.
**9. INTELLECTUAL PROPERTY RELATED COMPLAINTS**
We respect intellectual property rights. If you believe Content infringes your rights, follow the procedure outlined to report potential infringements.
**10. LINKS TO THIRD-PARTIES**
Brassbell Homes is not responsible for third-party websites or resources linked from the Site. Use such resources at your own risk.
**11. PRIVACY POLICY**

**12. DISPUTE RESOLUTION & ARBITRATION AGREEMENT**
We aim to resolve disputes amicably. Certain claims will be resolved through arbitration, unless exceptions apply.
**13. TERMINATION**
Brassbell Homes can suspend or terminate your Site access without notice. Such action doesn't make Brassbell Homes liable.
**14. MODIFICATION TO TERMS**
We can modify these Terms. Continued Site use after modifications means you accept the revised Terms.
**15. ENTIRE AGREEMENT**
These Terms replace any prior agreements and apply to all Content, Services, and Accommod
ations.
